SMS Terms & Conditions

By opting in to receive SMS messages from Lemon Head Design, you agree to the following terms and conditions. These messages may be sent on behalf of Lemon Head Design if you are a customer of one of our clients participating in our reputation management program.

Message Content

Our SMS program delivers information related to your service experience, including:

Review requests or satisfaction surveys
Appointment reminders or confirmations
Thank-you follow-ups
Occasional promotional offers or announcements (if opted in)

You will only receive messages relevant to your interaction with our company or one of our participating business clients.

Opt-In

You may opt in to receive SMS messages through:

Online web forms
In-store or point-of-sale forms
Digital intake or appointment booking systems
Other clear, conspicuous opt-in mechanisms

At the time of opt-in, you will be informed of the nature of the messages, message frequency, and how to opt out.

Message Frequency

Message frequency varies based on your interactions but generally does not exceed 2–4 messages per interaction unless you opt into ongoing promotional updates.

Opt-Out

You can opt out of receiving SMS messages at any time by replying:

STOP – to unsubscribe
HELP – to receive support contact information

Once opted out, you will no longer receive text messages unless you re-subscribe through an approved method.

Fees

Message and data rates may apply. You are responsible for charges billed by your mobile carrier.

Data Privacy

Your information will be used solely for sending relevant messages and will not be sold or shared outside the scope of your service relationship.

Participating Carriers

Supported carriers may vary and are not responsible for delayed or undelivered messages.

Limitation of Liability

Our liability is limited to the amount you paid through the service or $100 USD, whichever is lower. We are not liable for indirect or consequential damages.

"AS IS" and "AS AVAILABLE" Disclaimer

The service is provided without warranties of any kind. We do not guarantee error-free, uninterrupted service or virus-free communications.

Governing Law

These terms are governed by the laws of the United States, excluding conflict of law rules.

Dispute Resolution

For European Union (EU) Users

EU consumers will benefit from any mandatory provisions of their country of residence.

U.S. Legal Compliance

You represent you are not in a U.S.-sanctioned country or on a prohibited party list.

Severability and Waiver

Severability

If a provision is invalid, it will be modified to meet its intent, and the rest will remain valid.

Waiver

Failure to enforce any right does not waive the right to enforce it later.

Translation Interpretation

If translated, the English version of these terms shall prevail in case of a dispute.

Changes to These Terms

We may update these terms at any time. Material changes will be communicated at least 30 days in advance. Continued use of the service indicates your acceptance.
